1. Acceptance of terms
By accessing or using Dominio System (the "Service" or "Platform"), you agree to these Terms of Service (the "Terms") in their entirety. If you do not agree with any part, you must not use the Service.
These Terms constitute a legal agreement between you (the "Customer", "User" or "you") and Dominio System LLC, a limited liability company organized under the laws of Wyoming, United States, with business address at 30 N Gould St STE R, Sheridan, WY 82801, United States (hereinafter "Dominio System", "we", "us" or "the Company").
2. Definitions
- Service / Platform: the software-as-a-service (SaaS) offered by Dominio System, including the web dashboard, the AI Voice Agent, and related services.
- Customer / Subscriber: the individual or legal entity that contracts a subscription to the Service, typically a service business that handles its customers over the phone.
- Contacts: the persons who interact with the Service through phone calls or other channels managed by the Customer. Includes prospects, patients, and end customers of the Customer.
- Customer Data: information uploaded or generated by the Customer within the Platform, including Contact data, appointments, call recordings and transcripts, business configurations, and reports.
- Voice Agent: the artificial intelligence agent that answers phone calls by voice on behalf of the Customer. Each Customer configures their own agent (number, voice, script, and business knowledge). It operates through telephony, speech-to-text, text-to-speech, and language model providers.
- Subscription: enrollment in the Service under a recurring payment plan; the first period is charged upon account activation, with no free trial period.
3. Service description
Dominio System is an AI voice agent platform for service businesses. The Service includes, among other features:
- AI Voice Agent that answers phone calls 24/7 on behalf of the Customer (one dedicated agent per Customer)
- Call recording and transcription
- Lead qualification and automated appointment booking
- Contact management and business database
- Real-time reporting of calls and operational metrics
- Email notifications via Resend
- Payment processing through Stripe
The Service is provided "as is" and on a monthly subscription model.
4. Account registration and eligibility
To use the Service, you must:
- Be over 18 years old or have legal capacity in your jurisdiction
- Represent a legally constituted business
- Provide truthful, complete, and updated information
- Maintain the confidentiality of your access credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activity occurring under your account. Dominio System will not be liable for losses resulting from unauthorized use of your account if you did not notify the incident in a timely manner.
5. Plans and billing
5.1 Available plans
- Founding: $97 USD/month (fixed founding cohort pricing, subject to limited availability)
- Pro: $149 USD/month
- Enterprise: custom pricing, by invitation or direct request to soporte@dominiosystem.com
All prices are in U.S. dollars (USD) and do not include applicable taxes that may be added according to your jurisdiction.
5.2 Activation and first charge
We do not offer a free trial period. To subscribe you must provide a valid payment method; the first period is charged upon activation of your subscription. Before you confirm, you will clearly see the plan, amount, and billing frequency. You may cancel at any time from your dashboard, in the same number of steps it took to subscribe, and cancellation prevents any future charge.
5.3 Automatic renewal
Subscriptions automatically renew at the end of each billing period, until you cancel. By activating a subscription, you authorize Dominio System (through Stripe) to automatically charge your payment method on each renewal. Before each renewal we will clearly show you the amount and frequency of the charge. You may cancel automatic renewal at any time from your dashboard, in the same number of steps it took to subscribe; cancellation is processed immediately and prevents future charges.
5.4 Price changes
We reserve the right to modify prices. Changes apply only to future renewals and are communicated by email at least 30 days in advance. Customers on the Founding plan retain their fixed lifetime price as long as their subscription remains active without interruption.

6. Data ownership
6.1 Customer Data
You retain all rights to Customer Data. You grant Dominio System a limited, non-exclusive, worldwide, royalty-free license to process, store, and transmit Customer Data solely for the purpose of providing the Service to you.
6.2 Contact Data
You acknowledge that data of Contacts (prospects and customers of your business) processed within the Platform (including call recordings and transcripts, phone numbers, appointments, history) is your responsibility as data controller under applicable data protection laws (LFPDPPP in Mexico, GDPR in EU, etc.). Dominio System acts as a data processor on your behalf.
As the controller of your Contacts, you commit to:
- Disclose to callers that they are speaking with an artificial intelligence agent, where required by applicable law
- Provide notice and, where the law requires it, obtain consent to record calls (for example, in all-party consent jurisdictions)
- Obtain prior express consent from your Contacts before making outbound AI-voice calls (for example, the call-back feature), in compliance with the TCPA, Do-Not-Call (DNC) lists, and equivalent laws
- Obtain informed consent from your Contacts to process their data through Dominio System and third-party services (telephony, speech-to-text and text-to-speech providers, and language models such as OpenAI, etc.)
- Maintain your own Privacy Notice in compliance with applicable legislation
- Not upload to the Platform unnecessary sensitive data (detailed medical history, complete financial information, etc.)
6.3 Aggregated and anonymized data
Dominio System may use aggregated and anonymized data (usage statistics, sector trends, Voice Agent performance metrics) to improve the Service and publish general reports that do not allow identification of individual Customers or their Contacts.
7. Acceptable use
You commit not to use the Service for:
- Illegal activities under applicable laws (including money laundering, fraud, terrorism, human trafficking)
- Telephone spam, unsolicited calls or illegal robocalls, or violations of the TCPA, Do-Not-Call (DNC) lists, or telephony providers' policies
- Impersonating another's identity or falsely representing your affiliation
- Storing or processing minor's data without verifiable parental consent
- Processing sensitive medical data (HIPAA in U.S. — Dominio System is NOT a HIPAA-compliant provider)
- Reverse engineering, decompiling, or attempting to extract the Service's source code
- Attempting to access accounts, data, or systems that do not belong to you
- Deliberately overloading the Service's infrastructure
Violations of this section may result in immediate suspension without refund and reporting to competent authorities if applicable.
8. Telephony, call recording, and AI voice
The Voice Agent operates through third-party telephony and artificial intelligence providers (for example, Twilio for telephony, and speech-to-text, text-to-speech, and language model providers). Your use of the Service is subject to those providers' acceptable use policies and to applicable telecommunications and consumer protection laws.
As the Customer, you are solely responsible for using the Voice Agent lawfully. In particular, you acknowledge and agree that:
- Artificial voice (TCPA / FCC, U.S.): regulators consider AI-generated voices to be "artificial voice." Outbound AI-voice calls require the prior express (and, in some cases, written) consent of the called party, along with identification and opt-out mechanisms. You are responsible for obtaining and retaining that consent and for honoring Do-Not-Call (DNC) lists.
- Call recording: call recording is regulated by law. In all-party consent jurisdictions (several U.S. states and other countries) you must provide notice and/or obtain consent before recording. You define and are responsible for your agent's recording notices.
- AI disclosure: some jurisdictions require informing the person that they are interacting with an artificial intelligence system. You are responsible for meeting those disclosure requirements.
Dominio System provides controls to configure recording notices, AI disclosure, and consents, but the responsibility to enable and use them in compliance with applicable law is yours. Violations of providers' policies or of applicable law may result in the suspension of your number or your account, an event that may be outside of Dominio System's control.
9. Intellectual property
9.1 Dominio System ownership
The Service, including all its software, design, trademarks, logos, content, source code, documentation, and the "Dominio System" brand with tagline "automation platform", are the exclusive property of Dominio System LLC and are protected by United States and international intellectual property laws.
These Terms do not grant you any rights over Dominio System's intellectual property except the limited and revocable license to use the Service during your active subscription.
9.2 Suggestions and feedback
If you send us suggestions, feedback, or ideas to improve the Service, you grant Dominio System a perpetual, worldwide, royalty-free right to use such suggestions without obligation of compensation or attribution.
10. Termination
10.1 Termination by Customer
You may cancel your subscription at any time from your dashboard or by emailing soporte@dominiosystem.com. Cancellation is effective at the end of the current billing period.
10.2 Termination by Dominio System
We may suspend or terminate your account immediately, with or without prior notice, if:
- You violate these Terms or our Acceptable Use Policy
- You make fraudulent payments or dispute unjustified chargebacks
- You use the Service for illegal activities
- You maintain an outstanding balance for more than 14 days after the first failed billing attempt
- You cause reputational or legal harm to Dominio System
10.3 Effects of termination
Upon termination of your account:
- Your access to the Service ceases immediately
- Customer Data is retained for 30 days to allow recovery upon your request
- After 30 days, Customer Data is permanently deleted from our systems, except where law requires us to retain it
- Provisions on intellectual property, limitation of liability, and indemnification survive termination
11. Warranties and disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOMINIO SYSTEM DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.
We do not warrant that:
- The Service will operate without errors or interruptions
- The results obtained will be accurate, timely, or useful for your business
- Voice Agent-generated responses will always be appropriate or correct (it is an artificial intelligence system subject to the inherent limitations of such systems)
- Third-party providers (telephony such as Twilio, speech-to-text such as Deepgram, text-to-speech such as Cartesia, language models such as OpenAI, plus Stripe, Supabase, Vercel, or others) will operate without interruptions
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- DOMINIO SYSTEM'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
- DOMINIO SYSTEM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These limitations do not apply in cases of:
- Proven willful misconduct or gross negligence
- Violation of confidentiality obligations
- Cases where applicable law does not allow these limitations
Nothing in these Terms limits or excludes any mandatory, non-waivable consumer rights granted to you by the law of your country of residence. If you are a consumer domiciled in Mexico, you retain the right to turn to the Federal Consumer Protection Agency (PROFECO) and to the competent courts of your domicile under the Federal Consumer Protection Law.
13. Indemnification
You agree to indemnify and hold harmless Dominio System LLC, its directors, employees, agents, and affiliates, from any claim, damage, loss, or expense (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms
- Your violation of third-party rights (including privacy or intellectual property rights)
- Data uploaded by you to the Platform
- Actions taken by your Contacts related to your use of the Service
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflicts of law principles.
Any dispute related to these Terms or the Service shall first be submitted to a good-faith direct resolution process between the parties for 30 days.
If not resolved, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in English, seated in Sheridan, Wyoming, United States. The prevailing party shall be entitled to recover reasonable legal fees.
Notwithstanding the foregoing, either party may seek injunctive relief in competent courts to protect intellectual property rights.
15. Changes to these Terms
We may modify these Terms at any time. Material changes will be notified by email to your registered address at least 30 days prior to their effective date.
Continued use of the Service after the effective date of changes constitutes your acceptance of the new Terms. If you do not agree, you must cancel your subscription before that date.
16. General provisions
- Entire agreement: these Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between the parties.
- Severability: if any provision is held invalid, the rest remains in force.
- No waiver: our non-exercise of a right does not constitute a waiver of it.
- Assignment: you may not assign your rights without our written consent. Dominio System may assign these Terms without restriction.
